VAT litigation

VAT tax audits are frequent, particularly because VAT is the highest revenue tax in France. The firm assists, represents and defends its clients, both French and foreign companies, before the tax authorities in the context of tax audits. 

These VAT tax audits generally concern the verification of the correct application of VAT rates in certain areas (agricultural VAT, horticultural VAT, VAT on food, etc.), the consistency between the amounts indicated in the VAT returns and the amounts of turnover, and also deductible VAT, for which the rules are very strict. 

During a tax audit, the firm assists companies - in close collaboration with chartered accountants - in providing the information requested by the tax authorities. The firm represents its clients before the tax inspectors and helps to establish a calm, constructive and peaceful dialogue with the tax authorities.  

At the end of the tax audit, if the tax authorities issue tax reassessment, the firm assists its clients in the various stages of the procedure of contestation: drafting the taxpayer's responses, any appeals before the hierarchy, and contentious claims. 

If, despite all the pre-litigation steps, the outcome is not satisfactory for the companies, the firm may refer the dispute between the company and the tax authorities to the locally competent Administrative Court. 

The firm therefore intervenes at all stages of the tax procedure to ensure that the rights of companies are preserved, that the administrative tax procedure is respected and that the financial consequences suffered by the companies are proportional and legally justified.
